Kentucky Update October 2021

The Kentucky OSHA law reporting procedure has been updated. Previously, the February 2020 version stated as such:

Employers must report to the Division of Occupational Safety and Health Compliance any incident that results in a fatality or the hospitalization of 3 or more employees within 8 hours from when the incident is reported to the employer, the employer’s agent, or another employee. Incidents resulting in the loss of an eye, an amputation, or the in-patient hospitalization of 1 or 2 employees must be reported to the Division of Occupational Safety and Health Compliance within 72 hours from when the incident is reported to the employer, the employer’s agent, or another employee.

Currently, the most recent update as of September 2021 now states:

Employers must report to the Division of Occupational Safety and Health Compliance the work-related death of an employee, including death resulting from a heart attack, within 8 hours from when the incident is reported to the employer, the employer’s agent, or another employee. Work-related incidents resulting in the loss of an eye, an amputation, or the in-patient hospitalization of an employee, including hospitalization resulting from a heart attack, must be reported to the Division of Occupational Safety and Health Compliance within 72 hours from when the incident is reported to the employer, the employer’s agent, or another employee.

Florida Miami-Dade County Update October 2021

The Florida Miami-Dade County Minimum Wage has been updated. Dates effective: October 1, 2021 through September 30, 2022

Florida Update September 2021

The Florida Minimum Wage has been updated.

  • Dates effective: September 30, 2021 through September 29, 2022
  • New Minimum Wage: $10.00 per hour, or at least $6.98 per hour for tipped employees
  • Previous Minimum Wage: $8.65 per hour, $5.63 per hour for tipped employees.

Montana Update August 2021

The Montana Anti-Discrimination notice has been updated.

The notice states that Montana law prohibits discrimination & retaliation in employment, housing, education, etc., and that discrimination is unlawful if based on one of these protected classes: age, disability, race, marital status, etc., and effective August 2021, “vaccination status” is now included in the list of protected classes.

Georgia Update August 2021

The Georgia Workers’ Compensation notice has been updated. The title of the notice now conspicuously reads ‘Panel of Physicians” at the top, in large text.

This notice is labeled as WC-P1 from the state. This latest revision is dated July 2021, with the previous version dated July 2006.

Massachusetts Update August 2021

Effective August 2021, the Massachusetts state labor law posters have been updated.

There are two notices that have been updated on the MA state posters.
First, the Massachusetts Minimum Wage notice updated the clause about tipped workers. The section now states the following:

  • The average hourly tips, plus the hourly service rate paid to the worker must add up to the minimum wage per each shift.
  • Employers, owners and employees with managerial or supervisory responsibilities on a given day must never take any of your tips.
  • Tips and service charges listed on a bill must be given only to wait staff, service bartenders, or other service employees.
  • Tip pooling is allowed only for wait staff, service bartenders, and other service employees.

Second, the Paid Family Medical Leave notice was updated to include a health insurance clause. The notice now states: “Employers must continue to provide for and contribute to employees’ employment-related health insurance benefits, if any, at the level and under the conditions coverage would have been provided if the employees had continued working for the duration of such leave.” This latest revision is dated July 2021, with the previous version dated November 2020.

August 2021 State Updates Year-to-Date

After 8 months into 2021, there have been a number of important changes to state labor laws. While it is fairly standard for the state minimum wage increase laws to be released in January, sometimes there are other revisions released throughout the rest of the year. Kansas Update August 2021

The Kansas labor law postings for anti-discrimination have been updated, effective July 2021.

This is a MANDATORY update and all employers should make sure their posters are in compliance since the legal, statutory text has been revised. The exact change is on the Anti-discrimination poster for the state of Kansas. It states: “Kansas law provides equal opportunity in employment without regard to race, religious, color, sex, disability, national origin, ancestry, or age. Genetic testing and screening is also prohibited.”

The new addendum adds: “Sex includes LGBTQ+, all derivatives of sex, and pregnancy. Age is 40 or more years.”

In addition, the Dodge City Office contact information for the phone number and fax have been updated, and the Topeka main office added an email (khrc@ks.gov).

Nevada Update Scheduled for October 2021

Effective October 1, 2021, the Nevada state postings will have two new notices added to the labor law posters.

The first new notice to be added for Nevada labor law postings is Assembly Bill 190, which covers paid or unpaid sick leave. It details how employers must allow employees to use accrued sick leave to assist members of their immediate family for medical related reasons.

The second new notice to be added for Nevada labor law postings is Assembly Bill 307, which covers that the Department of Employment, Training, and Rehabilitation (DETR) post job training or employment programs run by the Department.

This update is scheduled to be effective on October 1, 2021.

Virginia Update July 2021

Effective July 1, 2021, covered Virginia employers with more than 5 employees for a 20-week period in the current/preceding year must now post a notice regarding reasonable accommodations for employees with disabilities. This is a new notice that will be added in addition to the other required state postings.

This is a mandatory update to the Virginia labor laws and employers must have up-to-date postings to stay in compliance or else risk getting fined during audits. Moving forward, all posters ordered from us will have this new updated posting included on our Virginia posters.
